Virginia Lawmakers Hoping for Decision Regarding Skill Games in 2022

The US Gambling industry reached new heights in 2021, breaking the record for highest annual revenue in just 10 months. A big part of the recent success has been due to an increase in sports betting. Many states jumped at the chance to legalize sports betting after the US Supreme Court overturned PASPA in 2018. As a result, several states also took this an opportunity to reevaluate their gambling laws in general.

Not every state has been as keen to allow widespread gambling. Virginia, for instance, is still working to get the state’s first casinos up and running. During the pandemic, the commonwealth only temporarily allowed skill gaming terminals throughout the state. The skill gaming terminals were originally legalized with hopes of providing a new source of income during the pandemic.

Virginia earned money from the fees on the gaming terminals. In total, the state raked in $130 million from legal terminals. The order legalizing the skill gaming terminals expired on July 1st. Since the order expired, the terminals were technically banned again.The legality of the ban on the terminals has been called into question. A county judge in Virginia granted a temporary injunction against the ban. As a result, the skill gaming terminals are legal, for now.

There is also no regulatory body overseeing the terminals. When the ban was temporarily lifted, Virginia’s Department of Alcohol and Beverage Control (ABC) was in charge of the terminals. However, the terminals were removed from ABC oversight when the ban was put back in place at the beginning of July.

The Argument for Legalizing Skill Games

Those opposing the ban on skill-based gaming machines are claiming the state does not have the right to issue the ban in the first place. Former NASCAR driver Hermie Sadler owns several Sadler Brothers Oil stores throughout the state. Sadler opposed the ban on the grounds that it violates the first amendment. Earlier this month, A Greensville County judge ruled in Sadler’s favor.

Sadler and other opponents of the ban argue that the terminals are similar to arcade games. The terminals require that players physically interact with them and have a skill component. Players have the ability to influence the outcome based on their skill level. According to Sadler and his supporters, that qualifies the entertainment machines for first amendment protection.

The machines themselves are good sources of income for both the state and the stores that offer them. Sadler has rallied support among the other small business owners that want to continue to use the machines. At a hearing in September, over 50 small business and convenience store owners were present to support Sadler.

Virginians’ fight to reinstate skill games has been ongoing for years. Prior to 2020, similar skill games had been allowed in the commonwealth. However, lawmakers banned the machines to make way for new casinos to be built in Virginia. Banning the machines eliminated competition for the new businesses. Many of Sadler’s supports had been using the previously legal machines for years. In some cases, small business owners had been using the machines for decades.

Why Some Virginia Lawmakers Oppose Legalized Skill Games

Sadler and other proponents of the gaming machines have the support of many small businesses throughout the commonwealth. However, that may not be enough. Those opposing the skill gaming machines are the ones making the laws in the commonwealth. State attorneys are appealing to Virginia’s supreme court to overturn the injunction.

Representatives of the state have pushed backed against Sadler’s argument regarding citizens’ first amendment rights. The defense argues that the skill gaming machines are illegal on the grounds that they offer cash prizes. They also argue that the small businesses that operate the machines are concerned with their profits, not their civil liberties. Ironically enough, profit could be one of the major reasons Virginia lawmakers keep fighting to put the ban back in place.

The initial ban on the machines in 2020 coincided with the construction of four brick-and-mortar casinos in Virginia. When the ban was temporarily lifted for pandemic relief, the commonwealth received income in the form of fees. There are no such fees in place under the current injunction. The machines themselves would also offer more competition for the casinos if they were allowed to continue to operate.

Another issue facing Sadler and his supporters is that the ban on gaming machines was passed with bipartisan support in both houses. It is, unfortunately, a rare sight to see Democrats and Republicans work toward a common goal these days. Their mutual opposition to skill gaming machines could spell trouble for Sadler.

The current injunction is in place until May 2022, but the issue could be resolved before then. Virginia’s General Assembly meets in January and legislators are pushing to resolve the issue then.

Connecticut announced today that a soft launch of its first sportsbooks will take place tomorrow, October 12. This state legalized sports betting back in May of 2021 and has been preparing to launch its first sports betting platforms on October 7. Officials here have been working hard to agree on specific regulations for this industry ever since.

A seven-day soft launch from the Connecticut Lottery Corporation, Mohegan Tribe, and Mashantucket Pequot Tribe will begin tomorrow. Assuming everything goes well, statewide online sports betting will become available. Several major sports betting operators are eagerly waiting for their first sportsbooks to launch here.

Florida is another state working to get its sports betting industry off the ground. Legal disputes between various pari-mutuel companies and the Seminole Tribe have led to delays doing so. Hope is that Florida’s first sportsbooks launch before the end of October.

US Casino Revenue Jumped Considerably in June

Many states recently released their casino revenue reports for the month of June. The majority of these states saw a major jump in their revenue figures. It’s great news for the various casino companies across the country.

New Jersey set a new monthly gambling revenue record this June. Combined GGR came out to $392.8 million last month. The land-based casinos in this state managed to bring in $214.5 million. $154.1 million was earned from slots and $60.4 came from table games.

Mississippi is known for having one of the largest casino industries in the Southern US. In June, the casinos here managed to bring in $147 million in total gross gaming revenue. That is a new monthly revenue record for the state.

Not every state’s casino industry saw such a large increase in gambling revenue. Massachusetts and Louisiana both ended up seeing revenue drops last month. Most analysts expect things to turn around in these states in July, though.

Georgia is one of the few states without any legal casinos. It now appears that there is another major push to finally allow Class III gambling venues in this state. Here’s what we know about this situation.

More Gaming Companies Push to Legalize Casinos in Georgia

Reports surfaced this week claiming that a group of several companies is now pushing to legalize casinos in Georgia. Major gaming companies including Caesars Entertainment, Bally’s Corporation, Hard Rock International, and Wynn Resorts are all pushing for this change. These companies (and others) have formed their own lobbying group in an attempt to change the state’s gambling laws in 2022.

This is likely the most intense effort to allow casinos in Georgia to date. The group claims that revenue from legal casinos would help to revive the HOPE Scholarship Program in the state, as well as bring money to various other education projects. Atlanta commercial real estate executive Rick Lackey spoke about a possible vote on this issue to the media this week.

“It would be a vote against $5 billion in brick-and-mortar construction and 50,000 new jobs in Georgia,” Lackey said. 

Gambling fans in Georgia are likely happy to hear about this new effort to allow casinos. There will be major pushback, though. Georgia is home to a huge number of anti-gambling groups that are expected form their own counter-lobbying effort.

This company, called SuperBook, has announced that it’s expanding to the Black Hawk’s Lodge Casino in Black Hawk, Colorado. Those who are familiar with this company are already getting excited. SuperBook currently operates the biggest sportsbook in Las Vegas.

The SuperBook is located at the Las Vegas Westgate Hotel. It’s 30,000 square feet and features the largest sports video wall in the city. This company is now teaming up with Jacobs Entertainment to break into the Colorado market.

JJ Garcia, vice president of operations for The Lodge, spoke about this new partnership to the media this week.

“Having Jay Kornegay lead this exciting opportunity is an added benefit Colorado fans are sure to appreciate,’’ he said. 

Jay Kornegay, the leader of this casino’s sports betting operations, is also optimistic about the future.

“We believe The Lodge is a perfect fit for our initial expansion opportunities outside Las Vegas,’’ he said. 

Initially, the new sportsbook in Colorado was set to open on May 1st. Due to new restrictions, this opening date is now being pushed back.

When Will the US Sports Industry Open Back Up?

Over the past month, the entire US professional sports industry has been turned upside down. This is due to the spread of a new coronavirus called Covid-19. This virus has a unique ability to spread and as a result, all professional sports have been forced to suspend their operations.

It seems very likely that the state will shut these venues down. Infection rates in Florida continue to increase. Soon, lawmakers here will have no other option than to close down all gambling establishments.

Current Gambling Laws in Connecticut, Explained

As we already mentioned, Connecticut is thought of today as a pretty liberal state when it comes to gambling. Today, most traditional forms of gambling are perfectly legal here. A couple of popular land-based casinos operate in this state, one of which is located in Ledyard and the other in Uncasville.

Both of these casinos are run by Native American tribes. These tribes were given permission to open the gambling venues after the Supreme Court passed the Indian Gaming Regulatory Act in the late 1980s. They now pay 25% of their slot revenue to the state.

For years, tribal leaders in Connecticut have been pushing to open a new casino in East Windsor. Unfortunately, the state has pushed against these plans, pointing out the fact that East Windsor is not sovereign land. It’s a complicated issue that continues today.

Certain lawmakers in this state have also been pushing to allow sports betting. Since May of 2018, every state in the country has been able to set its own laws on sports gambling. As of now, more than 20 states have chosen to legalize this form of gambling.

This week, members of the Senate Democratic majority began pressuring Governor Ned Lamont to expand Connecticut’s gambling industry. These Senate leaders officially endorsed a piece of legislation that would allow the state’s Native American tribes to offer sports betting inside casinos.

The bill would also allow for a new casino to be constructed in Bridgeport.

Lawmakers here pushed for this gambling expansion plan last year. Unfortunately, Governor Lamont struck these plans down. Senator Cathy Osten drafted this year’s legislation and believes that it will benefit the state in the long run. Senator Dennis Bradley agrees.

“This is about making sure that moving forward, everybody has a slice of the pie, that we don’t put people against each other,” Bradley said. 

Lamont and his team have not yet commented on the new plans. We’ll need to wait and see if he offers any objections over the next few months.

Online Casino Options Are Already Available in Connecticut
